What the law actually says

The Employees' State Insurance Act, 1948, was the first major legislation on social security in independent India. It is managed by the Employees' State Insurance Corporation (ESIC), a statutory body under the Ministry of Labour and Employment.

Who is covered?

As per the latest notifications from the Ministry of Labour, the ESI scheme applies to factories and 'specified' establishments (which include shops, hotels, restaurants, cinemas, road motor transport undertakings, newspaper establishments, and private medical and educational institutions) that employ 10 or more persons. The Wage Ceiling

If your salary increases beyond this limit during a "contribution period," you continue to be covered until the end of that specific period.

The Contribution (The Money Part)

The scheme is self-funded. As of 2024, the rates are:

  • Employee’s share: 0.75% of your gross wages.
  • Employer’s share: 3.25% of your gross wages.
  • Exemption: If your daily average wage is below ₹176, you (the employee) are exempt from paying your share, but you still get all the benefits. Your employer still pays their 3.25%.

Medical Benefit (Section 46)

Under Section 46 of the ESI Act, medical benefit is the most significant perk. Unlike private insurance, there is no "sum insured" limit.

  1. Full Medical Care: You and your family (spouse, children up to age 25, and dependent parents) are entitled to full medical care from the day you enter insurable employment.

    Your journey starts the day you join. Your employer is legally required to register you on the ESIC portal within 10 days of your joining.

The ESI system is massive, which means it often moves with the speed of a tired government bus. Even if you have your e-Pehchan card, you will likely hit one of these three walls. Here is how to climb over them:

1. The "Ghosting" Employer

You see the deduction on your salary slip, but when you ask for your IP number, HR makes excuses. This usually happens because the employer is deducting the money from you but pocketing it instead of depositing it with the ESIC.

  • The Workaround: You don't actually need your employer to "allow" you to check your status. If you have your UAN (from your PF account), it is often linked. 1. My salary just increased to ₹22,000. Will my ESI stop immediately?

No. ESI works in "Contribution Periods" (April to September and October to March). If your salary crosses ₹21,000 *during* a period, you stay covered until that 6-month cycle ends. After that, you exit the scheme. However, if you are a Person with Disability (PWD), the limit is ₹25,000.

2. Can I use ESI at a private hospital like Apollo or Fortis?

Only if that specific branch is "empanelled" (has a tie-up) with ESIC and you have a formal referral from an ESI doctor.
